Welcome to Melis by Sahar Al Aufi. The Melis website (the "Website") is owned and operated by Sahar Al Aufi (hereinafter referred to as "Melis"). By accessing, browsing, or registering on the Website located at sahar-alaufi.com (the "Website"), you, as a user, or any entity or individual you represent (collectively referred to as "User" or "Users"), agree to be legally bound by the terms and conditions set forth herein, along with any additional terms, conditions, or policies displayed on the Website (collectively, the "Terms").

Melis reserves the right, at its sole discretion, to amend, modify, update, or revise these Terms (collectively, "Modifications") at any time without prior notice. Any such Modifications shall replace and supersede the previous version of the Terms to the extent of any inconsistencies. Users are responsible for reviewing the most current version of the Terms, which will be made available on the Website. Continued use of the Website following the posting of Modifications constitutes the User’s acceptance of such changes.

If you do not agree to these Terms, as amended from time to time, you must immediately cease using the Website and its services. By selecting the acceptance checkbox during the checkout process and confirming payment on the Order Review page, Users expressly affirm their agreement to these Terms. Acceptance of the Terms is a mandatory condition for placing orders or using any services offered through the Website.

For the purposes of these Terms, the term "Representatives" shall include, without limitation, Melis’ employees, directors, officers, shareholders, affiliates, subsidiaries, agents, contractors, sponsors, advertising and promotional agencies, fulfillment agencies, consultants, and advisors.

This Site is operated by Reflection, a company organized and existing under the laws of the Sultanate of Oman, with its registered office at Al Mazoon St, Seeb 133, Muscat, Oman. Global-E serves as our international sales facilitation and fulfillment partner and will be the entity you contract with for any purchases of products or services. Global-E will process your payment, and approved carriers will deliver your orders. For full details of our returns and refunds policy, please refer to Section 14: Order Cancellation/Right of Withdrawal/Returning Orders.

We currently ship merchandise purchased on this Site to the following destinations: Brazil, Colombia, India, Mexico, Peru, Saudi Arabia, South Africa, Turkey, UAE, and Vietnam. This list is subject to change and may be updated periodically.

Except for your Submitted Materials (as defined in Section 6 below), Reflection and/or its licensors retain sole and exclusive ownership of all rights, title, and interest—including, without limitation, copyrights—in the Site and all its content. This includes, but is not limited to, all audio, photographs, images, illustrations, renderings, drawings, webcasts, RSS feeds, podcasts, services, graphics, logos, games, widgets, gadgets, applets, distributable applications, visuals, videos, text, software, code, data, and other materials contained on the Site (collectively referred to as the "Site Content").

Additionally, Reflection owns the look and feel, design, organization of the Site, and the compilation of the Site Content. This ownership includes, but is not limited to, copyrights, author’s rights, trademarks, patent rights, database rights, moral rights, sui generis rights, and other intellectual and proprietary rights.

Your use of the Site does not confer ownership, title, or any rights to the Site Content or any other part of the Site. Moreover, it does not grant you a license to use, display, or reproduce the Site Content, except as explicitly permitted by these terms.

Subject to compliance with these Terms, Melis grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, use, and display the Website and its content (the "Site Content") on your computer or other devices. This license is granted solely for your personal, educational, and non-commercial use.

Except as expressly permitted under applicable law or with our prior written consent (or the written consent of the applicable rights owner, where relevant), no portion of the Website, Site Content, or any products or services advertised, sold, or made available through the Website may be:

  • Copied, reproduced, republished, exploited, downloaded, uploaded, posted, transmitted, modified, adapted, or derived;
  • Reverse-engineered, disassembled, or decompiled;

Such Content is protected by applicable copyright laws and other intellectual property regulations.
  • Users are strictly prohibited from reproducing, publishing, distributing, displaying, modifying, creating derivative works from, or otherwise exploiting any Content, in whole or in part, without the prior written consent of Sahar Al Aufi or the relevant content supplier.     Sahar Al Aufi is under no obligation to maintain, retain, or return any Submitted Materials provided by you.

    While accessing or using the Website (www.sahar-alaufi.com), its content ("Site Content"), or any of the features and services available through the Website, you agree to comply with all applicable laws and regulations and refrain from engaging in any of the following prohibited activities:

    • Violation of Laws
      • Breach any applicable law, regulation, or rule.
    • Security Violations
      • Compromise the security of the Website, or attempt to gain unauthorized access to the Website, Site Content, or connected computer systems or networks. Any such breach may constitute a criminal offense, and we reserve the right to report your actions to relevant law enforcement authorities and disclose your identity if required.
    • Impersonation and Misrepresentation
      • Impersonate any individual or entity, real or fictitious, including any representative of Sahar Al Aufi or the Website, or misrepresent your affiliation with any other person or entity.
    • Harassment

      • Use the Website, its services, or Site Content to engage in or facilitate any activity prohibited by applicable law or regulation.

    Failure to comply with these Rules of Conduct may result in suspension or termination of your access to the Website and its services, as well as legal action where applicable.

    We reserve the right, but are not obligated, to monitor or review any content or materials submitted to or displayed on the Website (the "Site"). While we do not sponsor, endorse, or take responsibility for such content, we may, subject to our Privacy Policy, disclose any information or materials to third parties as necessary to comply with applicable laws, regulations, or governmental, judicial, or law enforcement requests.

    We further reserve the right, at our sole discretion, to edit, decline to post, or remove any content, in whole or in part, that:

    • Violates these Terms or any applicable laws or regulations;
    • Is deemed objectionable, offensive, or otherwise inappropriate.

    By using the Site, you acknowledge that you may be exposed to content that you find offensive, indecent, or objectionable. We are not responsible or liable for such content, except where we are at fault under applicable laws.

    Additionally, we are not responsible or liable to any third party for the content or accuracy of materials posted by you or other users of the Site, except in instances where our actions directly contribute to the issue.

    You may place orders for products on the Website (www.sahar-alaufi.com) only if you are at least 18 years old. By placing an order, you confirm that you have carefully read, understood, and agreed to these Terms, the Sahar Al Aufi Privacy Policy, and the terms of sale and privacy policy of our international sales facilitation partner, Global-E.

    Once your order is submitted, Global-E will send you an acknowledgment email containing an order reference number and the details of your order (“Order Reference”). Please note that the Order Reference confirms receipt of your order but does not constitute acceptance of the order by Sahar Al Aufi or Global-E.

    • Confirmation
    • Your order is considered accepted only when Global-E sends you an email confirming that the product(s) have been dispatched (“Shipping Confirmation”). A contract between you and Global-E for the purchase of the product(s) is formed upon issuance of the Shipping Confirmation. This contract applies only to the product(s) included in the Shipping Confirmation. Other items in your order will be confirmed separately upon their dispatch.

    • Price and Payment
    • Payment for orders placed on the Website is processed by Global-E or its authorized third-party payment processors. By placing an order, you agree to:

      • Pay the full amount due for your purchase in accordance with the Payment Information Policy.
      • Provide accurate and current billing and payment information for yourself or, if applicable, another person with their express consent.
      • Authorize Global-E to use payment processing tools and services to complete the transaction.
    • Pricing and Currency
    • The prices displayed on the Website are quoted in the local currency of your shipping destination and include VAT (if applicable) at the prevailing rate in the destination country. Prices exclude shipping charges, which are quoted separately and displayed in your order summary prior to checkout.

      If you are paying in a currency different from that of your bank account, your bank may charge additional currency conversion fees. Sahar Al Aufi and Global-E have no control over such charges. Similarly, your bank or card issuer may impose additional transaction or cross-border fees, which Sahar Al Aufi and Global-E cannot predict or mitigate.

      If your payment is not successfully processed, you agree to promptly pay all amounts due using the method prescribed by Global-E.

    • Customs and Import Duties
    • You may be responsible for paying import duties, taxes, and customs clearance fees when your shipment arrives at its destination. Customs policies vary by country, and Sahar Al Aufi recommends contacting your local customs office for detailed information. In some cases, Global-E may engage a local licensed customs broker to facilitate the import process. By placing an order, you authorize the broker to:

      • Conduct transactions with local customs authorities,
      • Execute relevant documents on your behalf,
      • Facilitate the payment of applicable taxes, and
      • Handle any necessary returns and associated tax reimbursement claims.

      If a return is processed in accordance with these Terms, Global-E may refund you the product cost but not import charges unless such charges are reimbursed by the relevant tax authority.

    • Product Availability
    • Sahar Al Aufi strives to provide accurate product availability on the Website, but availability is not guaranteed. Products may be out of stock or low in stock when you place your order, in which case your order may be rejected, and you will be notified via the email or phone number provided during checkout.

      Product availability, pricing, and promotions may differ between the Website and physical stores or vary by location. Prices displayed on the Website are valid only for the specified shipping destination.

    The images, colors, features, and sizes of products displayed on the Website are provided for illustrative purposes. While every effort has been made to ensure accuracy, the technical specifications, display settings, and resolution of your electronic device may impact the visual representation of the products.

    Occasionally, the Website may contain typographical errors, inaccuracies, or omissions in product descriptions, pricing, or availability. Prices and availability of products and services are subject to change without notice.

    If a pricing error for a product you ordered is identified after your order has been confirmed, we will contact you to either reconfirm your order at the corrected price or cancel the order. If we are unable to reach you within a reasonable time, your order will be canceled, and any payment made will be refunded.

    We may engage third-party companies to assist with order reference and delivery notifications. These third parties may require your delivery address and phone number as part of the order and delivery process. Your phone number may be used to address difficulties in locating your delivery address and to notify you of the expected delivery time or updates. By placing an order and agreeing to these Terms, you consent to the disclosure of this information to third parties solely for order confirmation and delivery purposes, in accordance with our Privacy Policy. For the purposes of this Section, “we” also includes Global-E and any third-party companies engaged for delivery and notification services.

    • Delivery Process
    • The delivery of products is governed by our Shipping and Delivery Policy. Products will typically be delivered within 30 days of order confirmation. You may track your order at any time using our Order Status page by providing your email address and order number or by clicking the tracking link provided in your Shipping Confirmation or Customer Invoice email. Alternatively, you may contact a customer service representative using the details in Section 23 of these Terms.

    • Delivery Details and Tracking
      • The stated delivery period is approximate and subject to change.
      • Products will be sent to the address provided at the time of order placement.
      • For orders containing multiple items, shipments may be sent separately. Each shipment will have its own tracking number, available under the same order number on the Order Status page.
      • Shipping charges (if any) will be applied to the first package shipped in cases of multiple shipments.
    • Compliance with Laws
    • If fulfilling an order would violate any applicable laws, including export controls or sanctions, Sahar Al Aufi and Global-E reserve the right to cancel or cease processing the order at any stage, including after dispatch and notification of order confirmation. We shall not be liable for any cancellation or delay arising under such circumstances.

    • Customs and Inspections
    • International shipments may be subject to cross-border inspections by customs authorities. You are responsible for any associated customs duties, taxes, or clearance fees.

    • In-Store Pickup
    • At this time, we do not offer the option to pick up online orders in physical Sahar Al Aufi stores. If you wish to make a purchase in-store, please use the Store Locator on our website to find a location near you.

    • Delivery Restrictions
    • Orders placed on www.sahar-alaufi.com can only be shipped to addresses within the destinations listed in Section 1 of these Terms. Orders from outside these destinations must specify a delivery address within the listed destinations. If you wish to purchase products for delivery in another destination, please visit the Sahar Al Aufi website corresponding to that region, if available.

    • Faulty Goods
    • Products are classified as faulty if they are received damaged or exhibit manufacturing defects within 12 months of purchase (or any longer period as required by applicable Omani consumer protection laws). Customers are kindly requested to return the faulty product using the pre-printed return form and return label included in the parcel. If the return label is missing, please contact Customer Service for assistance. Products that are damaged, worn, or used beyond being tried on will not be accepted. Sahar Al Aufi is responsible for ensuring that products sold on the Site comply with the applicable laws of Oman, including the Consumer Protection Law promulgated by Royal Decree No. 66/2014, which guarantees consumer rights regarding the quality, safety, and suitability of purchased goods.

    • Warranty Conditions
    • The product warranty is valid only if both the following conditions are met:

      • The fault occurs within 12 months from the delivery date (or within a longer statutory period, if applicable under Omani law); and
      • The consumer submits a formal claim regarding the fault within a reasonable period from the date it was discovered.

      In accordance with the Consumer Protection Law of Oman, consumers are entitled to:

      • Repair or replacement of the faulty product at no additional cost;
      • An appropriate price reduction; or
      • Termination of the contract and a full refund for the affected product(s).
    • Submitting a Claim
    • Claims must be submitted via email to the contact address listed in the "Contact" section of the Site or through any other communication method specified by Sahar Al Aufi.

    • Return Costs
    • The cost of returning faulty products will be borne by Sahar Al Aufi. Additionally, any refund for the returned product(s) will include the original shipping charges, in accordance with Omani consumer protection regulations.

    • Right of Cancellation/Withdrawal
    • You have the right to cancel an order within the period specified below if you decide not to keep the product. However, this right does not apply to:

      • Custom or personalized products,
      • Sealed products where the seal has been broken (e.g., beauty or fragrance items),
      • Swimwear or underwear with the hygiene strip removed,
      • Other specified products, as indicated on the product page.

      The cancellation period begins from the date the order is placed. Please refer to the table below for specific timelines.

    • Notifying Us of Cancellation
    • To exercise your right to cancel, you must inform us of your decision through the provided Cancellation Form or by contacting Customer Service via the "Contact Us" form. You will receive an email confirmation once your cancellation request is processed.

    • Refunds
    • If you cancel your order within the permitted time:

      • Product Refund: You will receive a refund for the product price, subject to a reduction if the product has been handled beyond what is necessary to assess its nature or functionality.
      • Delivery Refund: You will be refunded for delivery costs, up to the cost of the least expensive delivery method offered.
      • Refunds will be processed within 14 days of receiving your cancellation request or once the returned products are received, whichever is earlier.
    • Returning Products
    • If a product has already been delivered:

      • You must return the product within 30 days of notifying us of your cancellation.
      • Returns should be made via the return portal, using the pre-paid return label provided. If you use another courier, you are responsible for return costs, including any additional customs duties or taxes incurred.

      • Products must be returned within 30 days of delivery and comply with the guidelines in our Return Policy.
      • Exchanges are not available for online purchases.

      Steps for Returning Items

      • Securely pack the merchandise, preferably in the original shipping materials.
      • Use the returns portal to initiate a return authorization form.
      • Print the pre-paid return label and form.
      • Include the form in the package and affix the label.
      • Drop off the package at an authorized service point or request a pickup.

    You have legal rights in relation to products that are faulty or not as described. These legal rights are not affected by your right of cancellation, return and refund or anything else in these Terms.

    RETURNING A GIFT

    Gifts can be returned by post only, as outlined above, when accompanied by a gift receipt or the original returns form. Please note that refunds can only be processed against the original account in the same form of payment in which it was received, unless payment was made in the form of cash on delivery (where applicable), in which case your refund will be returned via bank transfer or paypal.
